Development Variance Permit 2016-003

Council for the District of Sparwood will at the Regular Meeting at 7:00 p.m. on August 15, 2016 consider Development Variance Permit 2016-003 & Mobile Home Park Permit 2016-001 for a portion of Lot A DL 9525 & 9488 KD Plan NEP65613 (7555 Highway 43) as shown on the reverse of this notice to:

  1. Vary Section 4.6.2 to reduce the minimum width of the mobile home space from 15 metres (49.2 feet) to the width shown in Schedule C for spaces A5, A6, A7, A8, C9, D4, D5, D14, E2, E3, E5, E6, E8, E12, F9, F13, F14, and F15;
  2. Vary Section 4.9.3 to reduce the minimum separation between mobile homes from 6.1 metres (20 feet) to 3.97 metres (13.0 feet) for the mobile homes currently on spaces A4, A5, A6, A7, A8, A9, C5, C6, C8, C9, C10, C14, C15, D3, D4, D5, D13, D14, D15, E3, E4, E13, E14, F6, F7, F9, F10, F12, F13, F14, and F15;
  3. Vary Section 4.9.3 to reduce the minimum separation between accessory buildings and the mobile home from 1.21 metres (4 feet) to 0 metres (0 feet) for the existing accessory buildings on spaces A2, A5, A12, A14, B2, C5, C6, C8, C9, C14, D4, D9, E2, E3, E4, E6, E8, E12, and F12;
  4. Vary Section 4.9.2.a to reduce the side yard setback from 1.52 metres (5 feet) to 0.04 metres (0.13 feet) for the existing mobile homes on spaces F13 and F14;
  5. Vary Section 4.9.2.b to reduce the side yard setback from 3.05 metres (10 feet) on the side of the mobile home that has the main entrance to 1.99 metres (6.53 feet) for the existing mobile homes on spaces A5, A7, A8, D4, D13, D14, E14, F9, and F18;
  6. Vary Section 4.9.2.d to reduce the front and rear setbacks from 4.57 metres (15 feet) to 2.22 metres (7.28 feet) for the existing mobile homes on spaces E13, F3, F6, and F12;
  7. Vary Section 4.9.3 to reduce the minimum separation between accessory buildings and the mobile home space line from 1.52 metres (5 feet) to 0 metres (0 feet) for the existing accessory buildings on spaces A4, A9, C9, D4, E2, E3, E4, E6, E9, E10, E12, E13, E14, F4, F6, F10, and F18;
  8. Vary Section 6.2 to remove the requirement that roads are designed, drained, and surfaced in accordance with Schedule “B” of the Subdivision Control Bylaw;
  9. Vary Section 8.1 to remove the requirement that the water supply system is constructed in accordance with Schedule “C” of the Subdivision Control Bylaw and the current system be considered legal non-conforming subject to receipt of approval from Interior Health;
  10. Vary Section 9.1 and 10.1 to remove the requirement that the sewer supply system is constructed in accordance with Schedule “D” of the Subdivision Control Bylaw and the current system require certification by a Registered Wastewater Treatment Practitioner and be considered legal non-conforming;
  11. Vary Section 11.1 to remove the requirement that for a drainage collection and disposal system is constructed in accordance with Schedule “E” of the Subdivision Control Bylaw; and
  12. Vary Section 14.1 to remove the requirement that street lighting be installed and maintained in accordance with Schedule “B” of the Subdivision Control Bylaw.

These submissions must be received by no later than 4:00 p.m. on August 15, 2016 in order to ensure their availability to Council at the Regular Meeting.
